【禁闻】大陆“新婚姻法” 男人笑女人哭

【新唐人2011年8月20日讯】新婚姻法、房子、产权、爱情……一时间成了红极一时的网路热词,大陆最高人民法院关于婚姻法的最新司法解释一公布,立即引发了网路男女的“口水仗”。不少网友认为新婚姻法是男人的“福音”,保护了在婚姻中处于强势地位的一方,损害了女性,作为弱者一方的利益。

大陆最高人民法院12号公布的《关于适用〈中华人民共和国婚姻法〉若干问题的解释(三)》,从13号开始实施。消息一出立刻掀起一轮讨论风暴,网友纷纷关注这项规定实施后,对婚姻、家庭各方会带来什么样的影响。

《新解释》共有19个条文,其中一条首次明确夫妻一方个人财产,婚后产生的孳息和自然增值不是共同财产。

新婚姻法存在着对于女性朋友的诸多不利因素:
1.婚后房产不归于女方,却要共同承担房贷。
2.离婚后,房产权依然归男方所有,女方只能得到相应的补偿。
3.假使男方出轨,离婚后女方没有资格争夺房产权,即使有参与还房贷,也依然不属于女方财产。

郭宪彰(台湾知名律师):“我觉得比较奇怪的是,假如是先生,因为有外遇所造成的离婚,竟然,太太这边,她所受到的保障我觉得还比较少。除非它还能搭配婚姻法里面,离婚可归责原因一方应该赔偿另外一方,这样的概念,要不然,对妻子来讲是弱势更加弱势。”

因为“新婚姻法”的实施,南京的朱女士成了第一个牺牲品。

大陆媒体报导,8月8号星期一开庭时,根据婚姻法司法解释二的条款,朱女士的委托律师还在主张她拥有一半的房产权。可才过了一个星期,就在一审判决下达前的周末,婚姻法司法解释三突然落地,于是那套婚房与朱女士半点关系都没有了。而庭审时已经确认朱女士的丈夫曾两次出轨。

大陆许多女性忧心,新婚姻法条约将无法保障自己的权利,不少网友直接批评,“婚姻法司法解释”没有人性,是依强欺弱,发出了“老公约等于房东”、“铁打的房子,流水的媳妇”等感慨。

反观西方很多国家,离婚之后的女性可以获得赡养费一直到再婚,由于国外信用制度的完善,女方索要孩子的抚养费也是非常容易的。

举例日本,房贷几乎伴随购房者一生,如果离婚,女方甚至可以获得70%的房产,这样“显失公平”的法律,却能有效约束日本社会家庭稳定。而根据近年新修改的日本婚姻法,提起离婚诉讼的妻子可获得丈夫退休金的一半。

网友草帽在[市民论坛]发表意见,他说国外的法律都是保护女性的,怎么中国这点不和国际接轨了!

另一位网友也表示,中国有那么多法律法规不完善,偏偏婚姻法在房子到底归谁这点上做完善,难道制定法律那位爷家里有好几个儿子,他首付了好多套房子?只有利益真的触碰到规则制定人自己的时候,他才会着急敏感吧。

China’s Controversial New Marriage Law

New marriage law, house, property and love …
have recently become online buzz words.
China’s Supreme People’s Court’s release of the judicial
interpretation of the marriage law immediately triggered
an online bickering among male and female netizens.

Many netizens think that the new marriage law is a “gospel"
for men to protect their interests in their marriages,
at the cost of the more vulnerable females’ interests.

China’s Supreme People’s Court issued on August 12,
“The Interpretation to China’s Marriage Law”.
It came into effect on August 13.
Its release immediately set off a storm of discussions.
Netizens are concerned about its impacts on
marriages and the families.
“The New Interpretation" has 19 clauses,
one of which stipulates that the interests generated by
and appreciation of a personal property belonging to one
spouse is not the common property of the couple.
The new law has many unfavorable factors to the wives:

1. In the marriage, real estate properties don’t belong to
the wife, who still needs to share the mortgage payments.
2. After the divorce, all real estate properties belong to the man.
The wife can only be compensated accordingly.
3. If the husband is unfaithful, the divorced wife is not eligible
to compete for the property rights.
Even if the spouses shared mortgage payments,
the properties still don’t belong to the wife.
Guo Xianzhang (well-known Taiwanese lawyer):
“I found it rather strange.
If the husband’s disloyalty results in a divorce,
the wife receives less protection.
Unless it states in the Marriage Law that the party, whose
actions caused the divorce should compensate the other party,
otherwise, the wife becomes more vulnerable."

Ms. Zhu from Nanjing has become the first victim of
the new Marriage Law.
According to Chinese media, at the hearing on August 8,
according to the previous judicial interpretation of the law,
Ms. Zhu’s lawyer claimed that she had the right to
half of the property.
However, a week later, the new interpretation came out.
The property now has nothing to do with Ms. Zhu.
The court has already confirmed that
Ms. Zhu’s husband had twice cheated on her.
Many Chinese females are worried about the new Marriage
Law will not protect their rights.
Netizens criticized, “The judicial interpretation is inhumane,”
“Husbands are land lords,” and
“The house is made of iron;
the wife is made of running water.”
In many Western countries, divorced women can receive
spousal support from their ex-husbands, until they remarry.
It is also very easy for the females to ask for
child support payments from their ex-spouses.
In Japan, house owners have a virtually lifetime mortgage.
After the divorce, the wife can obtain 70% of the property.
These “unfair" laws effectively ensure
the social and family stabilities in Japan.
According to the recent revised Marriage Law of Japan, the
wife that filed for divorce can get half of the man’s pension.
A netizen nicknamed “straw hat” said that the laws
in foreign countries are to protect females.
How come China is not following the international standards
in terms of the marriage law?
Another netizen micro-blogged that China has so many laws
and regulations with loopholes, except the marriage law.
The marriage law maker must have many sons and
made lots of down payments for the houses.
The law must affect his interests,
for him to put in such clauses.
