【禁闻】张雪忠因言获罪 曝光七不讲 遭停聘

【新唐人2013年12月12日讯】中国“华东政法大学”教授张雪忠,因为发表呼吁宪政改革的文章,近期被学校停职。这一消息公开后,张雪忠立刻得到了学界和大量网民的声援。海外媒体也纷纷关注、报导。

张雪忠是“华东政法大学”法律学院教师,因多次发表呼吁宪政改革、反对一党专政、反对马克思主义等内容的文章和书籍,被校方两次停课。

12月9号,“华东政法大学”法律学院的负责人代表学校,与张雪忠约谈。张雪忠被告知,由于他写了《新常识》一书,及发表《2013反宪政逆流的根源及危险》等文章,在学校作出停课处理后,仍一直不能认识自己的所谓“错误”,因此学校将不再续聘他。

解聘张雪忠的校内通告在微博传开,随后引发了大批公共知识份子和网民的关注,人们几乎一面倒的站出来声援张雪忠,并谴责“华东政法大学”。但相关言论遭到了当局的屏蔽和强删。

中国人权民运活动家赵常青妻子刘晓冬:“张老师是一个为人非常温和也非常有正义感的一个人,我对他遭受这样不公平的待遇觉得很遗憾。”

张雪忠对外界透露,他向校方代表表示,一所大学如果因为教师的思想和观点而对他政治迫害,这不但将成为一起严重的公共事件,而且还可能成为一桩截入史册的丑行。

张雪忠当时还说:“我希望学院和学校领导,能秉承法学教授的公正精神和专业良知,不要沦为专横权力的帮凶,更不要做出让‘华政’蒙羞的事情。”

中国宪政学者陈永苗:“只能说中国现在的大学都是党的学校,它其实不是大学了,它已经都是党务的部门延伸。”

据了解,张雪忠的《新常识》一书,主要探讨“一党专政是否正当与合理”,以及中国目前“一党专政制度的性质与后果”。

另外一根导火索,是张雪忠发表于今年6月的长文《2013反宪政逆流的根源及危险》。

在此之前的一个月,中共内部下达的扼杀高校民主思潮的“七不讲”,曾被张雪忠率先在网路曝光。随后,《红旗文稿》等中共喉舌连续发表了一系列反对宪政、批判普世价值的评论文章。张雪忠在6月发表的长文中,对极力“反宪政”的人士进行了犀利的批评,而再次激怒了当局。今年8月,学校以“违背教师职业操守”为由,将张雪忠全面停课。

而这并不是张雪忠第一次“因言获罪”,早在去年9月,张雪忠就因为在微博上发表了反对香港“国民教育”的言论,被校方剥夺了他对本科生的授课资格。张雪忠在微博上怒斥:作为校领导,你们的首要职责本是捍卫教师的思想、学术和言论自由,而不是充当政治权力钳制言论、打击异见的帮手。我希望你们的决定能够对得起自己的良心,经得起历史的考验。

大陆文化评论家叶匡政:“其实夏业良和张雪忠被大学除名,应该早就有这种传言了,就是大学和传媒要处理一批批评政府这样的一些异议人士。但实际上,他们这个做法,我个人觉得很不明智的。”

据“华东政法大学”内部人士透露,张雪忠因2009年在新加坡《联合早报》发表的《中国需要去马克思主义化》等政治敏感文章,在学校年终考核中被评定为“不合格”,理由是“政治思想差”。

对此,毕业于“华东政法大学”的上海律师斯伟江,在博客中批评:“这种以考核不合格,以要求别人屈服、认错来羞辱一个大学教师,是多么‘文革’的一种作风。对于一个政法大学,这本身是一种羞耻。”

有评论认为,除了上述言论和文章,张雪忠的一些“反党”行为早已让当局恨之入骨,例如,张雪忠强烈反对中共对青年的政治灌输。2011年,他曾致信教育部门,建议取消政治考试科目,让大学生免修马克思主义课程。

而去年9月,张雪忠在微博公开声明“退党”,震撼中国海内外。

Professor Zhang Xuezhong Dismissed Over His Writings

Professor Zhang Xuezhong has been suspended from
his duties by East China University of Politics and Law.
This is because he published articles
calling for constitutional reforms.
After the news broke, Professor Zhang received
large support from academics and internet users.
International media also picked up the story,
and reported on Professor Zhang’s situation.

Zhang Xuezhong is a Professor at the School of
Law in East China University of Politics and Law.
He was twice suspended from his duties,
due to the articles and books he published,
which called for the constitutional reform.

Professor Zhang Xuezhong is also critical
against one-party dictatorship and Marxism.

On December 9, the person in charge of the School of Law
spoke with Professor Zhang, on behalf of the university.
He was told that the university will no longer
re-appoint him, as he failed to recognize his
“error” after he was suspended for the first time.
The first suspension from duties was due to the content
of his articles, such as “the roots of anti-constitutional
countercurrent in 2013, and the related dangers.”

The campus notice of dismissal spread over
Weibo, and attracted the concern of many
public intellectuals and internet users.

People stood up and provided overwhelming
support for Professor Zhang Xuezhong.
People also condemned East China
University of Politics and Law.
The relevant supportive words were
deleted and blocked by online censors.

Liu Xiaodong, wife of Zhao Changqing,
Chinese human rights and democracy
activist: “Professor Zhang is a gentleman.

He is also a person with a sense of justice.
I feel very sorry for his unfair treatment.”

Zhang Xuezhong told overseas media that he told
the university representative that if the university
conducts political persecution due to his thoughts
and ideas, it will become a serious public event.
It will also become known as scandalous behavior.

Professor Zhang Xuezhong: “I hope that the leaders from
the school and the university will adhere to the spirit of
justice, and especially to their conscience as law professors.

I hope that this happens, instead of becoming
accomplices of the imperious authorities.
Please do not do such a shameful thing to
East China University of Politics and Law.”

Chen Yongmiao, Chinese constitutional scholar: “We have
to admit that the universities in China belong to the CCP.
In fact, they are the extension of the CCP
departments, instead of true universities.”

It was understood that Zhang’s book “New
Common Sense” focuses on discussions of
whether one-party rule reasonable or not?

It also mentioned the nature of one-party dictatorship
in China, and all of the related consequences.

The other fuse was an article Zhang published
this June, called, “the roots of anti-constitutional
countercurrent in 2013, and the related dangers”.

Previously, the CCP issued the document, “do not
speak seven things” to all the universities in China.
It stifled any democratic ethos remaining in universities.

This is not the first time that Zhang
was punished for his words.
In September last year, he was deprived
of his undergraduate teaching qualification.
This was because he published writings in Hong Kong
via Weibo, which were against “national education”.
Professor Zhang scoldingly wrote that as a university
leader, your primary responsibility is to defend the ideas
of teachers and the freedom of research and expression.

This is instead of suppressing speech, and
fighting against dissidents, for political power.
I hope that your decision can be worthy of
your conscience, and stand the test of history.

Ye Kuangzheng, cultural critic: “Rumors of the dismissal
of Xia Yeliang and Zhang Xuezhong existed for some time.
The universities and the media deal with some
dissidents who criticize the government step by step.
But in fact, I personally feel this practice is very unwise.”

According to sources at East China University of Politics and
Law, Zhang Xuezhong published a series of sensitive articles.
This included an article on Lianhe Zaobao
called, “China needs to remove the Marxism”.
Therefore, he was assessed as “unsatisfactory”
in the university end-of-year assessment.
This was for his “poor political thought” .

Shanghai lawyer Si Weijiang, who graduated from
the same university, wrote critically on his blog.
“By using this kind of assessment to ask others
to give in and submit, it is a way to humiliate a
professor in the style of the ‘Cultural Revolution’.

For a university of political science and
law, it should be ashamed of itself.”

Some commentators believe that there is other
behavior by Zhang Xuezhong that was deemed
“anti-party”, and has also angered the authorities.

Zhang Xuezhong strongly opposes the CCP’s
political indoctrination of young Chinese people.
In 2011, he sent a letter to the education sector,
and proposed the abolition of political test subjects.
Therefore, the students could be
exempt from Marxism courses.

Last September, Professor Zhang posted
a public statement through Weibo.
He announced that he has quit the Chinese Communist
Party, which shocked people both inside China, and abroad.
