大陸發起的所謂打擊網路謠言的運動,最近愈演愈烈,在幾百人因網絡言論被中共公安投入監獄之後,9月9號,中共最高法院和最高檢察院又召開記者會,規定網絡所謂誹謗信息,被轉500次可以判刑。

消息傳出立刻引起輿論一片嘩然。

大陸網民紛紛指出,「兩高」作為大陸的最高司法機關,居然推出這種無視基本法律和法治原則的司法解釋,等於是敲響了法治的喪鐘,中國將退回到三十多年前,公安可以隨意抓人定罪的「文革」時代。

大陸法律學者童之偉表示,「兩高」將刑法293條尋釁滋事罪條款中的「公共場合」擴大到虛擬的網絡空間,實際上是立新法。依照中共憲法,立新法只能由全國人大或人大常委會通過立法或立法解釋來進行,「兩高」無權這樣做。

北京律師楊學林公開建議全國人大常委會緊急開會,制止「兩高」的規定實施。

上海律師孔濤則認為,「兩高」越權立法,說輕是篡權、說重是造反。

桂林小學爆炸 疑為訪民所為

9月9號,桂林市靈川縣八里街學校門外發生嚴重爆炸,造成2人死亡、44人受傷。

據大陸媒體報導,警方已經初步確定疑犯,懷疑他駕駛三輪車經過現場時引爆炸彈,他已在爆炸中死亡。

總部設在香港的「中國人權民運信息中心」表示,死者是一名經常上訪的訪民。

港人捐款李旺陽妹疑遭國保截留

香港華人民主書院去年6月發起在香港中聯辦門外絕食活動,為湖南六四受害者李旺陽籌得了7.2萬港元。這筆錢今年7月已經匯給了李旺陽的妹妹李旺玲,但是,李旺玲至今沒有收到。

據香港《明報》報導,負責匯款的香港華人民主書院董事陶君行說,他們也沒有收到退款,而李旺玲一家的生活仍然困難。

李旺玲的丈夫趙寶珠表示,湖南國保曾警告他們這筆錢不可以拿,並聲稱要調查捐款人是不是所謂的敵對勢力,以及捐款是否用於顛覆活動。

Lawyer: “Supreme Court And Supreme Procuratorate Making
Law Outside The Constitution Rules- Intending to Rebel?"

In Mainland China the so-called anti Internet rumors’ movement
has recently intensified; several hundred people were imprisoned.
The Chinese Communist Party (CCP) Supreme Court and
Supreme People’s Procuratorate had a press conference on Sept 9.
They announced the interpretation of the criminal cases which
use information networks to slander etc, now fall under the law.
It is clearly defined that people who spread defamatory
information which is forwarded 500 times can be sentenced.

The news immediately caused a public uproar.

Mainland netizen pointed out the Supreme Court and Supreme
Procuratorate are mainland China’s highest judicial offices.
They launched this judicial interpretation which disregards the
basic principles and the rule of law.
This equals sounding the death knell for the rule of law,
China will return to 30 years ago when police could arbitrarily
arrest and convict people during the “Cultural Revolution" era.

Mainland legal scholar Dong Zhiwei said that expanding the
“Public Places" in Criminal Law article 293 “Crime of picking
quarrels and provoking troubles" to virtual cyberspace is
actually establishing a new law.
According to the CCP Constitution, a new law can only be
processed by National People’s Congress or the Standing
Committee for legislation.

The Supreme Court and Supreme Procuratorate cannot to do so.

Beijing Lawyer Yang Xulin publicly recommended the NPC
Standing Committee have an emergency meeting to stop the
Court implementation.

Shanghai Lawyer Kong Tao believes the Supreme Court and
Supreme Procuratorate ultra vires legislation, can be regarded
as usurping if taken lightly or as rebellion if looked at severely.

Guilin Primary Explosion Believed To Be Carried
Out By Petitioner

On Sept 9 a severe explosion happened at Guilin Lingchuan
County Bali Street School, leaving two dead and 44 injured.

According to Mainland media, police have initially identified
the suspect who detonated a bomb while driving a tricycle
past the school,. The suspect died in the explosion.

China Human Rights and Democracy Information Center
based in Hong Kong believe the deceased was a petitioner who
often went to petition.

Hong Kong Peoples’ Donations To Li Wangyang’s Sister
Suspected Of Being Kept By National Security

Hong Kong “Chinese Democracy College" launched a hunger
strike at the Liaison Office of the Central People’s Government
in the Hong Kong Special Administrative Region (LOCPG HK)
in June 2012.
They raised 72 000 HKD for Hunan “June 4th" victim Li
Wangyang.
The money was apparently sent to Li Wangyang’s sister Li
Wangling in July 2013, but she still hasn’t received the money.

According to Hong Kong , Tao Junxing, director
of “Chinese Democracy College", who is responsible for the
remittance said they did not receive the refund either, while
Li Wangling’s family still have a difficult life.

Li Wangling’s husband Zhao Baozhu said that Hunan National
Security warned them “Do not take the money".
They claimed to investigate if the donors are “hostile forces",
and if the donations are used for “subversive activities".
