【禁闻】中共娱乐公司禁售节目予《新唐人》

【新唐人2013年10月18日讯】作为一家立足于中国海外的非政府中文电视媒体,《新唐人电视台》的报导向来真实、客观、独立。由于《新唐人》多年来有关民主、法制的报导,已经成为中国持续改革的重要推动者之一。然而,由于《新唐人》对许多中国社会人权侵害的报导,尽管有些问题已经得到当局的重视,中共党内的强硬派却不断利用各种手段百般封锁、压制《新唐人》。在中共对《新唐人》的压制过程中,多方干扰《新唐人》播出广受观众好评的各类节目,是最常用的手段之一。目地是想借此削弱《新唐人》的影响力与观众群,从而破坏《新唐人》的信誉。

中共广电总局在2010年11月,给大陆各省、自治区、直辖市广播影视局,以及中央电视台、电影频道节目中心等单位,下发了一道通知。

通知说,“不得以任何形式将影视节目提供给《新唐人电视台》,在向境外出售各类影视节目时,必须与购买方约定,不得将节目授权或转授权给《新唐人电视台》,并不得将节目用于任何与法轮功有关的播出。违者将“严肃
追究”责任。

通知还抄送给中共“中央610办公室”,并要求被通知部门“严格保密”。

去年2月,《新唐人》通过中介公司向“泰盛娱乐公司”购买了50集电视连续剧《鹿鼎记》。仅仅在播出一周后,“泰盛”突然以“版权过期”为由,要求《新唐人》停播《鹿鼎记》。

《新唐人》再三要求“泰盛”提供有效版权的可替换电视剧,并明确表示不能再出现贩卖“版权过期”的电视剧这种错误。

在“泰盛”重新确认了有效日期,并保证没有问题后,《新唐人》在去年4月再次与“泰盛”签约,并播出连续剧《雪山飞狐》,替换原先的《鹿鼎记》。

连续剧《雪山飞狐》一共40集,《新唐人》播出4集后,却收到中介公司要求停播的通知。“泰盛”承认遭到来自中共(强硬派)的压力,要求《新唐人》停播《雪山飞狐》。

为逼迫《新唐人》停播,“泰盛”重演故伎,再次搬出之前强迫《新唐人》停播《鹿鼎记》的理由:《雪山飞狐》版权无效。而他们之前已向《新唐人》保证肯定有效。

去年5月,“泰盛”以版权为由起诉《新唐人》,却在不久之后因缺乏法律依据而撤诉。

一年以后的今年8月,“北京慈文影视制作有限公司”却以所谓“版权持有者”的身份,通过美国一家律师公司,以版权为由起诉《新唐人》,并向《新唐人》索求巨额赔偿。

《新唐人》副总裁周世雨表示,这个事情它不是一个简单的版权纠纷。

“泰盛”在去年撤销了对《新唐人》的起诉,这说明他们的起诉缺乏法律依据。并且“泰盛”承认公司总部受到来自中共强硬派的压力。

在一年后的今天,“慈文”又在同样的压力下做出同样的事情。周世雨相信,这是中共控制宣传这一支强硬派,也是造成中共腐败的这一派,又在兴风作浪。

周世雨表示,中共不遗余力的打压《新唐人》,是因为《新唐人》坚持传播自由讯息,这是中共最为害怕的。

总部位于美国首都华盛顿的“人权法律基金会”执行主任泰瑞马甚(Terri Marsh)博士曾说:《新唐人电视台》报导的自由,和言论不受侵权与干扰等自由,都受美国法律的保护。中共广电总局对《新唐人》的践踏与漠视,不但对中国今天的改革没有任何帮助,反而背道而行。

Chinese Regime Interference with NTD Television

As an independent Chinese media NGO outside of China,
NTD’s reporting has always been truthful, objective,
independent and cutting-edge.
Based on NTDTV’s pioneering pro-democracy
rule of law reporting,
it has been singled out as a most important catalyst
of the ongoing reform in China.
However, because NTDTV has been reporting truthfully
about many abuses that the current regime is also addressing,
the hardliners in the Party have used a variety of methods to suppress NTDTV.
One of the most common ways used by the CCP is to interfere
with the broadcast of most popular and in-demand programs,
so as to drastically reduce the influence and viewership of NTDTV,
and thereby destroy NTD’s reputation and bankrupt NTDTV financially.

In November 2010, the SARFT issued a notice to all
provincial level bureaus and film organizations.

The notice inform that not to license any of
their programs to NTDTV in any way whatsoever.
“When selling programs overseas, it is necessary to
make an agreement with overseas distributors not to license
directly or indirectly any programs to NTDTV.
Any violators will be held severely accountable.”

The notice was copied to the 610 Office and required
to be kept confidential.

In February 2012, NTDTV purchased a 50-episode drama
series Deer from Tai Seng.
After only a week of broadcast, Tai Seng requested NTDTV
to stop broadcasting based on an expired copyright license.

NTDTV repeatedly asked Tai Seng to provide a replacement
drama series with a valid copyright license and explicitly
made it clear that such a mistake must not be repeated again.
Tai Seng assured them that they had a valid copyright.
Thus, NTDTV signed a contract with Tai Seng in April 2012
and started broadcasting Fox in place of Deer.

Fox is a 40 episode drama series.
After 4 episodes, it received a notice from Tai Seng,
this time admitting that it had come under pressure from
the CCP (hardliners) in China.
It required Tai Seng to stop NTDTV’s broadcast of Fox.

In order to ensure that NTDTV would comply, Tai Seng used
the same pretext they had used to stop NTDTV’s broadcast of Deer:
that the copyright they had assured NTDTV
was valid was in fact invalid.

In May 2012, Tai Seng sued NTDTV, but soon withdrew
because they did not have a valid basis in the law.

One year later, in August 2013, Beijing Ciwen retained a
US law firm and is now suing NTDTV for copyright
infringement as the purported copyright owner,
and asking NTDTV for huge amounts of damages.

NTD Deputy President Zhou Shiyun says that this is not a
simple copyright infringement lawsuit.

Last year Tai Seng withdrew their lawsuit because they do
not have a legal basis.
It is also proof that Tai Seng came under pressure
from hardliners at the CCP.

However, a year later, Ciwen is doing the same thing under
the same foreign pressure.
Zhou Shiyun believes that the hardliners in the CCP, who are
controlling the propaganda department and are responsible for
corruption in China, are also stirring this up."

Zhou also stated that the hardliners continued suppression of
NTDTV is because it continues to provide free, uncensored
news to China, which is what they are most afraid of.

Dr.Terri Marsh, Executive Director of the US-based
Human Rights Law Foundation commented.
“SAFRT ’s disregard of and infringement upon
NTDTV’s rights of freedom of speech and press, freedom
from tortious interference with contract, and related protections under
U.S. law do not serve reform in China;
indeed, they threaten to undermine that process.”
