【禁闻】疯狂!维权律师被控“煽颠罪”逮捕

【新唐人2014年06月23日讯】广州维权律师唐荆陵,在当局以“涉嫌寻衅滋事罪”将他刑拘超过30天后,广州警方再以涉嫌“煽动颠覆国家政权”罪将他正式逮捕。外界指出,中共当局近期抓捕维权或异见人士,大多以“寻衅滋事”或“扰乱社会秩序”罪名,而将唐荆陵与“煽动颠覆国家政权”的政治罪联系起来,是明显的不顾法律的疯狂升级打压。

广州维权律师唐荆陵的妻子汪艳芳,6月21号中午发布消息说,她已经拿到派出所的通知,通知说,唐荆陵因涉嫌所谓“煽动颠覆国家政权”罪被逮捕。

汪艳芳号召各方律师发起研讨会,探讨“法律的边界在哪?涉嫌煽动颠覆国家政权的罪证在哪?”

十多年来,唐荆陵因关注人权、参与维权、追求民主宪政,推动公民不合作运动等,长期遭到当局监控、软禁、强制旅游和强迫失踪。他的妻子也丢掉了工作。“监控、传唤、软禁”,成为唐荆陵夫妇他们生活的常态。

江西律师郭莲辉:“唐荆陵是个非常优秀的律师,他要求中国改革、要求中国走向民主、自由、法制、宪政的社会,他是为老百姓而呼、为老百姓而喊。但是当局容不了他,对他进行构陷迫害。特别可笑的是,原来拘留他的时候是寻衅滋事罪,现在逮捕他又变成了颠覆国家政权罪。”

江西律师郭莲辉表示,法律在中国像是当官的人手中的玩物,想怎么办就怎么办,罪名也可以随便安。

唐荆陵的辩护律师刘正清说,唐荆陵的“煽动颠覆国家政权罪”是不成立的,因为他没有要推翻现政权。如果把他定性为“煽动颠覆国家政权”,只能说中国的政治疯了。

唐荆陵辩护律师刘正清:“他根本没有构成煽动颠覆国家政府的行为,没有这种行为。”

近几天,中共媒体还宣传说,将选择上海、广东、吉林、湖北、海南、青海6个省市,先行司法体制改革试点,为全面推进司法改革积累经验。

郭莲辉:“当局不想把这个社会建成一个法制的社会,他们所宣传的、他们所说的全部都是假的,而且他们这种说假话、说套话、说官话,这种行为是几十年一贯制的。”

郭莲辉指出,中共的“维稳”其实永远是一个双刃剑,抓了唐荆陵,却唤醒更多的人。他相信,会有更多的唐荆陵站出来。

今年42岁的唐荆陵,自1998年开始在广州从事律师工作,多次为底层民众“维权”。由于他在2005年“太石村罢免村官事件”中,帮助受迫害村民诉讼,担任辩护律师,而被当局吊销律师执业证。

2006年以后,唐荆陵发起了“中国公民不合作——赎回选票”行动。他正式提出“选票里面出政权”的理念,并宣导通过“非暴力行动”改变中国。

今年4月底,唐荆陵曾因前往苏州,去祭奠“文革”遇难者林昭,而被警方拘押超过两天。

5月1号,广州警方以“涉嫌寻衅滋事罪”再次刑拘唐荆陵。同一天被刑拘的还有袁新亭、王清营,他们和唐荆陵三人在网间有“广州民主三剑客”之称。

北京律师王宇:“他是一个非常温和、非常非暴力的手段的一个律师。而且这么多年了,又被官方吊销执照什么的这么多的打压,已经给他迫害多年了。”

北京律师王宇认为,当局最近抓捕了“新公民运动”的主要创始人和标志性人物许志永,和律师浦志强,以及抓捕浦志强的辩护律师屈振红等多名律师,这种对律师界的打压反而给了律师们动力,令他们会更加清醒的去维护自己的权利。而抓捕唐荆陵,反而促成他“维权”地位的提升。

Human Rights Lawyer Arrested on “Inciting Subversion of State Power”

Guangzhou rights defending lawyer Tang Jingling was detained
for more than 30 days accused of the crime of provocation.
Recently, the Guangzhou police arrested him again on suspicion
of inciting subversion of state power.
When Beijing arrests activists or dissidents
on the crime of provocation or disturbing public order,
connecting Tang Jingling with a political crime is criticized
as an obvious insane and unlawful suppression.

On June 21, lawyer Tang Jingling’s wife Wang Yanfang said
a police notice arrived, stating that Tang Jingling was
arrested on suspicion of “inciting subversion of state power."

Wang Yanfang called on lawyers to initiate a forum onwhere
the legal boundaries lie and what is the evidence to support
suspicion of inciting subversion of state power.

For more than 10 years, Tang Jingling has been subject to the
authorities’ monitoring, house arrest, forced to travel,
and forced to disappear for his activities in human rights,
the pursuit of constitutional democracy and promotion of civil
disobedience movement.

His wife also lost her job.

“Monitoring, subpoena, under house arrest,"
has become the norm in their lives.

Jiangxi lawyer Guo Lianhui:
“Tang Jingling is an excellent lawyer.
On behalf of the people, he demands reform, for a
democratic society, freedom, the rule of law and constitution.
But the authorities can not tolerate him but set him up
for persecution.
It is absurd that he was detained on provocation, but then
arrested on subversion of state power."

Guo Lianhui says that the law has become a manipulating tool
of the Communist officials.

Tang Jingling’s lawyer Liu Zhengqing indicates the charge
of inciting subversion of state power cannot be sustained.
It can only be explained that politics in China is going crazy.

Liu Zhengqing: “His behavior did not constitute incitement
to subvert state power."

The CCP media has recently reported that pilot studies on
reform of the judicial system will be conducted in Shanghai,
Guangdong, Jilin, Hubei, Hainan, and Qinghai.

Guo Lianhui: “The authorities have no intention for a legal
society. For decades, these false claims have been consistent."

Guo Lianhui indicates that stability maintenance is actually
CCP’s double-edged sword, which arrested Tang Jingling
and woke up more people.

He believes there will be more to stand out like Tang Jingling.

The 42-year-old Tang Jingling has engaged in grassroots rights
defending since 1998.
In 2005, the authorities revoked his lawyer’s license for his
legal advice to victims of Taishi Village Incident, in which
villagers had intended to dismiss corrupt local officials.

In 2006, Tang Jingling initiated the disobedience campaign.

He proposed “political power out of the ballot”
and advocated the “non-violent reform” of China.

April this year, the police held Tang Jingling more than two
days due to his visit to Suzhou, where he paid homage
to the victim of the Cultural Revolution, Lin Zhao.

On May 1, the Guangzhou police again detained him
on suspicion of provocation.
Also detained were Yuan Xinting and Wang Qingyin.

The three of them were known to the netizens
as the Three Democracy Musketeers of Guangzhou.

Beijing lawyer Wang Yu: “His tactic has been very gentle
and non-violent.
But he has been persecuted for many years,
including suppression by revoking his lawyer’s license."

Wang Yu believes that the recent suppression of the lawyers
has instead motivated them, from arrest of the new
citizens’ movement founder Xu Zhiyong, lawyer Pu Zhiqiang,
to Pu Zhiqiang’s defending lawyer Qu Zhenhong.
Lawyers will only become more awakened
and active in defending their rights.
The arrest of Tang Jingling, will only elevate his rights
defending status.
