【新唐人2012年10月27日訊】中共在下個月召開的「18大」，將選出新一屆的領導班子。在這權力交接的時刻，當局對於犯有多項罪行的前重慶市委書記薄熙來的案件審理，顯得格外小心翼翼。中共喉舌媒體以「快訊」的方式，報導薄熙來被終止全國人大代表職務，也就代表了他不再享有「刑事豁免權」。薄熙來家屬委託的辯護律師表示，雖然還不清楚中共當局是否允許他在開庭時為薄熙來辯護，但他認為，薄熙來被終止全國人大代表職務，對薄案的程序影響不大。
中共喉舌媒體《新華社》報導，大陸全國人大常委會26號公告：「重慶市人大常委會罷免了薄熙來的11屆全國人大代表職務。依照代表法的有關規定，薄熙來的代表資格終止。」
有分析指出，薄熙來被終止全國人大代表職務，就失去了全國人大代表享有的「免予起訴的豁免權」，他將面臨被正式逮捕和起訴。時事評論員史達表示，中共當局可能重判薄熙來。
時事評論員史達：「習近平上臺一定要立威，他正好拿薄熙來開刀，薄熙來罪行牽扯到政變、活摘，中共要有個交代，所以它也是要拿薄熙來處理，還有，胡溫跟習近平一派，要遏止毛派勢力，要打擊血債派，所以這拳打下去，一定是要把血債派、毛派的勢力打趴下，所以重判的可能性相當的大。」
《華盛頓郵報》引述兩名匿名的谷開來親人的話，他們說，薄家的兄弟姐妹被警告：不可以為薄熙來聘請律師。不過，儘管如此，薄熙來岳母範承秀仍然為他的女婿聘請了兩名律師，分別是瀋志耕及李肖霖。
李肖霖對《自由亞洲電臺》說，他受到薄熙來岳母範承秀的委託，擔任他的辯護律師。
大陸律師 李肖霖：「我們還 沒有介入，我們接受了委託，但還沒有跟司法機關接觸。」
李肖霖表示，外界高度關注的薄熙來案，不太可能在18大召開之前進行審理。目前他們只是接受薄家委託，但還沒有獲得官方認可，也不清楚中共當局是否允許他在開庭審理時為薄熙來辯護。
對此，時事評論員藍述認為，和處理谷開來案件一樣，中共當局可能以「指定辯護律師」的方式，來「走過場」。
時事評論員 藍述：「他(中共)為了儘快的像處理王立軍和谷開來那樣的，去處理薄熙來，那麼，需要律師像演一場戲一樣。谷開來、王立軍（案件）走過場那樣子。所以他就需要一個他自己 指定的人，完全去控制這個局面。」
藍述表示，中共當局阻止薄熙來家屬聘請律師辯護，是因為薄熙來牽扯的犯罪事件太多，涉及的人員也不少，尤其是國際社會都在關注的「活摘器官」這一項。
時事評論員 藍述：「因為這個『活摘』是一個國家性犯罪，它不是哪一個個人能完成的，所以從江澤民、羅幹到周永康，從上到下這一系列的人，他都要處理，那麼在這種情況之下，他就有可能在這個問題上觀望。總之，它現在仍然是希望在解決這個問題之後，仍然能夠維持中共的統治。」
薄熙來被罷免人大代表職務前，紐約維權團體「人權觀察」 （Human Rights Watch）研究人員林偉（Nicholas Bequelin）說：「這是一場戲。」，「結果決定後，法官才會行動。薄熙來知道得太多了，跡象顯示我們看不到一場真正的審判。」

Lawyers to Defend Bo Xilai Hasn’t Been Approved
The Chinese Communist Party’s (CCP) 18th National
Congress will decide new leadership soon.
At this special moment, the CCP is proceeding very carefully
regarding how to properly deal with Bo Xilai.
The CCP mouthpiece reported the removal of Bo’s
representative position at the National People’s Congress (NPC).
It indicates that Bo is no longer entitled to have
criminal immunity.
The lawyer that Bo’s family members hired said he isn’t clear
if the CCP will allow him to defend Bo during the trial.
He believes that the removal of Bo as NPC’s representative
won’t effect the procedure of Bo’s case.
The Xinhua News Agency reported that the CCP
announced on Oct. 26 that the People’s Congress Committee
in Chongqing has dismissed Bo’s representative position.
According to the law, Bo has been removed.
Analysts pointed out that due to Bo’s removal,
he is no longer entitled to have criminal immunity.
Bo is awaiting formal accusation and arrest.
Shi Da, current affairs commentator,
said that Bo may face heavy sentences.
Shi Da: “Xi Jinping must build his power when he takes office,
and he will use Bo’s case to build his power.
Bo’s crimes involve a planned coup and live organ harvesting.
The CCP must be responsible, thus they have to deal with Bo.
In addition, Xi Jinping, Hu Jintao, and Wen Jiabao wanted
to curb the Mao faction’s power, and will attack the blood-debt faction.
When this punch is thrown, they definitely want to beat
the Blood Debt Faction and Mao’s faction to the ground, so there is a great possibility of a heavy sentence for Bo.”
The Washington Post cited two relatives of Gu Kailai who
claimed Bo’s brothers and sisters received warning that no lawyer is allowed to be hired for Bo.
However, Bo’s mother-in-law, Fa Chengxiu, still hired
two lawyers, Shen Zhigeng and Li Xiaolin.
Li Xiaolin told Radio Free Asia that Bo’s mother-in-law
asked him to defend Bo.
Li Xiaolin: “We haven’t intervened yet, we accepted the
commission, but haven’t contact the judiciary.”
Li Xiaolin said that outsiders focus on Bo’s trial,
but the trial is unlikely to be dealt with before the 18th Congress.
At moment, they just accepted commission without
formal approval by officials.
Li is unsure whether the CCP will allow him to serve
as the defense for Bo during the trial.
Lan Shu, Current affairs commentator, believes that
Gu Kailai’s trial will be the same.
The CCP might appointed a lawyer for Bo just to follow
procedure.
Lan Shu: “The CCP will quickly deal with Bo’s trial
just like when dealing Wang Lijun and Gu Kailai’s.
Then, lawyers are needed just for show, like
the Gu and the Wang trial.
Thus it needs appointing a lawyer to control the situation.”
Lan Shu said that the CCP is preventing Bo’s family from
hiring a lawyer, as Bo has committed many crimes involving too many officials.
Specifically, the international society is most concerned about
the live organ harvesting.
Lan Shu: “As live organ harvesting is a national crime,
it wasn’t simply one single person that made it happen.
From Jiang Zemin, Luo Gan to Zhou Yongkang,
people from the high-levels to the bottom-level will be punished.
Thus, some people are observing.
They still hope to maintain the CCP’s power after
solving this problem.”
Before Bo’s removal as an NPC representative,
Nicholas Beqelin, research fellow of New York Human Rights Watch, said, “This is a show.”
“The decision will be made before the judges’ move.
Bo knew too much, there won’t be a practical trial.”
